On June 13, 2024 a Federal judge in the Mock v Garland case vacated ATF 2021-08F.

What does this mean?

The rule being vacated essentially acts like the rule never existed and we are going back to how things were prior to the rule going into effect. With the rule being vacated, you can now legally use braced firearms as you see fit and don’t have to be associated with any of the parties that the injunction applied to.

On March 29 2024, CMMG is continuing our commitment to a legal lawsuit (no. 23-11157) against the ATF and the ATF’s brace rule, ATF 2021-08F.  This action represents our commitment to our customers first and foremost.  We are gunowners too and joining a united front against those who want to take our 2nd Amendment rights is something CMMG takes personal. As the rule sits right now there is no closure or clarity for a manufacturer or customer to comfortably move in a confident direction. This statement shows that there is a voice for the people in the fight and we want partners and customers alike to know that manufacturers, such as CMMG, are doing its part to fight against our eroding liberties. We plan to continue to fight for our 2nd amendment rights and what is rightfully ours.

Starting today, CMMG is resuming building and shipping pistol brace equipped BANSHEES. We will continue to carefully monitor the situation in the event an appeal to the injunction comes forward.

We are all just as happy to see the most recent nationwide pistol brace injunction as you are! While this may free you up to enjoy your AR pistols a bit more, we still have to monitor the situation from a manufacturer’s perspective. Being given our ability to manufacture firearms by the BATFE, we have to look at as many details as we can, and hash things out with our lawyers before we move on this. While waiting is not ideal, we have to be careful with how we proceed if we’d like to continue providing quality firearms to you.

As of 2/17/23, CMMG has joined passionate industry partners in a legal lawsuit against the ATF to show that not only CMMG has been impacted by the ATF’s final rule ATF 2021-08F but also expose the government’s blatant overreach threatening our liberties and freedoms as gun owners/manufacturers. This is a message that we want partners and customers alike to know that CMMG does care about those eroding liberties. We plan to continue to fight for our 2nd amendment rights and what is rightfully ours.

On January 13th, 2023 the BATFE (ATF) announced a final ruling on stabilizing braces (ATF-2021-08F ATF 2021R-08 Notice of Proposed Rulemaking: Factoring Criteria for Firearms with Attached "Stabilizing Braces" | Bureau of Alcohol, Tobacco, Firearms and Explosives
CMMG is opposed to this rule which is a complete reversal of prior guidance by the ATF. In response to the ATF’s final rule, CMMG will continue to do our due diligence in notifying you, the people, of changes in the industry and this situation. CMMG will also continue to stand beside our partners in the industry to create a cohesive response and unified stance to challenge this unjust rule. In the interim, due to the uncertainty and the advice of legal counsel, CMMG is taking action to comply with the rule, as we understand it, and are temporarily suspending shipment of pistols with stabilizing braces. With this change in production, rest assured we are actively fighting this ruling.
